These Terms & Conditions (“Terms”) govern the access and use of digital services, software systems, verification processes and payment integrations provided by EFORMX Digital Solutions Pvt. Ltd.. By accessing or using any service, you agree to these Terms. If you do not agree, please discontinue the use of our services immediately.

1. Acceptance of Terms

By using our website, platform or services, you acknowledge that you have read and accepted these Terms along with our Privacy Policy and Refund Policy. These documents constitute a legally binding agreement.

2. Eligibility & User Obligations

To use our services, you must:

• Be 18 years or older
• Provide accurate personal and business details
• Complete identity verification (KYC / e-KYC) when required
• Not use the platform for unlawful or unauthorized activities

EFORMX reserves the right to deny or suspend services if provided information is false, incomplete or non-verifiable.

3. Identity Verification (KYC / Aadhaar e-KYC)

For compliance, fraud-prevention and security, we may require identity verification. This may include:

• Government ID (Aadhaar, PAN, etc.)
• Phone/Email OTP verification
• Business documents (if applicable)

Aadhaar e-KYC, if used, is performed strictly with user consent and in accordance with applicable guidelines. Aadhaar numbers are not stored unless required by law and are strictly encrypted.

4. Services Provided

Our services include but are not limited to:

• Web & software development
• CRM and digital business management systems
• Secure IT infrastructure & cloud systems
• Identity verification supported modules
• Payment gateway integration & technical support

Services may change, update or discontinue without prior notice as part of improvement or maintenance.

5. User Responsibilities

• Maintain confidentiality of login details
• Use the platform only for lawful and legitimate purposes
• Ensure data provided is correct and complete
• Not attempt to hack, damage or misuse the system

6. Payment Terms

Payments must be made using the official payment methods integrated into our system through authorized payment gateways such as Razorpay, Cashfree, PayU, Paytm, etc.

• We do NOT store card, UPI or banking credentials.
• All transactions are processed through PCI-DSS compliant gateways.
• Invoices are generated digitally for every successful payment.

7. Secure Refunds, Cancellations & Settlements (RBI Compliant)

In case of service cancellation, incorrect payments, failed transactions or verified disputes, EFORMX processes refunds strictly through RBI-authorized and PCI-DSS compliant payment gateway partners such as Razorpay, Cashfree, PayU or other approved providers.

All refunds, reversals and settlements are executed using the official gateway payout API or refund API, ensuring:

• Full RBI guideline compliance
• Secure, traceable and auditable transaction flow
• Safe handling of user funds
• No offline or unauthorized refund mechanisms

For security reasons, identity verification (KYC/e-KYC) may be required before a refund or payout can be processed.

8. Payout Rules (If Applicable)

If any service involves payouts (partners, platforms, resellers, etc.), the following rules apply:

• Complete and verified KYC is mandatory
• Bank account must match verified identity
• Payouts may be held in case of suspicion or compliance checks
• Gateway delays or bank delays are beyond our control

9. Data Protection & Security

EFORMX implements advanced security measures to protect your personal information. Our data protection includes:

• Encryption of sensitive data
• Secure server infrastructure
• Access control & authentication
• Regular security audits
• Compliance with data protection guidelines

10. Prohibited Uses

You may not use EFORMX services for:

• Illegal or fraudulent activities
• Money laundering or identity misuse
• Unauthorized payment processing
• Harmful or abusive actions
• Violations of payment gateway policies

11. Intellectual Property Rights

All software, content, images, branding, trade names and materials on the EFORMX platform are the intellectual property of EFORMX Digital Solutions Pvt. Ltd. No duplication is allowed without written permission.

12. Limitation of Liability

EFORMX is not responsible for:

• Gateway-side failures or technical downtime
• Incorrect information submitted by users
• Indirect or consequential losses
• Unauthorized account access caused by user negligence

13. Suspension or Termination

We may suspend or terminate access to services if:

• False information is provided
• Fraud or suspicious behavior is detected
• Services are misused or violated
• Charges or verification remain incomplete

14. Updates to Terms

EFORMX reserves the right to modify these Terms at any time. Updated Terms will be posted with the most recent date.

15. Governing Law

These Terms are governed by the laws of India. Any legal proceedings will fall under the jurisdiction of Kanpur Nagar, Uttar Pradesh.
